PixCone Free and Beta Versions Terms of Use

This Terms of Use is a legal agreement between visitors to pixcone.com and users of PixCone Infographic Web Editor and the mentioned Author (Francesco Ricceri) of this Software for the software product identified above, which includes online PixCone Infographic Web Editor itself and may include associated media, printed materials, electronic documentation (“SOFTWARE PRODUCT”).

By visiting, remaining on www.pixcone.com and using the online PixCone Infographic Web Editor, you are agreeing to this Terms of Use along with all applicable laws and regulations.

If you do not agree with any of these terms, please do not access this site (www.pixcone.com) or use the PixCone Infographic Web Editor.

All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, clipart, libraries, and examples incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, are owned by the Author of this Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material.

Using the SOFTWARE PRODUCT

PixCone Free Version and Beta Versions are being distributed as Freeware for personal, commercial use, non-profit organization, educational purpose.

This Terms of Use grants you the following rights: Online Web Application Access, Online Account Creation and online Use.

Other Rights and Limitations

You may not reverse engineer, decompile, or disassemble, or change the SOFTWARE PRODUCT.

Update and Maintenance

PixCone Free Version and Beta Versions upgrades are FREE of charge.

Termination

Without prejudice to any other rights, the Author of this Software may terminate this Terms of Use, stop or suspend access to www.pixcone.com in any case, especially if you fail to comply with the terms and conditions of this Terms of Use.

Use of PixCone Infographic Web Editor and use of Infographics created with it

The licensed users or licensed companies can use all functions, example, templates, clipart, libraries and symbols in the SOFTWARE PRODUCT to create new infographics and visual assets. They are allowed to distribute their infographics and visual assets for personal, commercial use, non-profit or educational purpose.

Users are responsible to not use PixCone Infographic Web Editor to create or publish any immoral, illegal or offensive content.

All users own the copyrights of all graphic contents they create using PixCone (all versions). Graphic contents created with Free and beta Versions must publish the PixCone’s watermark in any medium (this watermark is automatically generated).

Uploaded Content

Users retain the ownership and copyrights to all content they uploaded to PixCone. This refers to images in JPEG,JPG,PNG,SVG format and to datasets in text format.

Users are responsible to not upload or to publish any immoral, offensive or copyright-protected content.

Users are liable for any damages resulting from the infringement of copyrights, trademarks, proprietary rights or any other harm resulting from content they created with PixCone.

Health and Safety

Use of PixCone is entirely at users risk, for which the Author is not liable.

LIMITED WARRANTY

NO WARRANTIES.
The Author of this Software expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you (the user).

NO LIABILITY FOR DAMAGES.
In no event shall the author of this Software be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software is aware of the possibility of such damages and known defects.
